Troubled Times for The U.S. Supreme Court
Abstract
This article will analyze the decrease in public trust of the Supreme Court across recent years. It will define the standards for legitimacy within the law and the courts and examine factors that play a role in shaping public trust and opinion. The rise of conservatism, the “over-politicization” of the courts, and the increase in the use of emergency decisions, otherwise known as “shadow-dockets”, will be discussed in order to analyze how the Supreme Court’s legitimacy has been damaged.
